The charge by the state against Ruth Thompson Dickins, he said, was murder in the first degree, the definition of which assumed malice aforethought. In response to which they could return one of five verdicts:

Guilty as charged, which carried with it a death sentence in the electric chair.

Guilty as charged with sentence set by the jury at life imprisonment.

Guilty as charged but unable to agree on punishment, in which case the judge would have no other option than to issue a sentence of life in prison.
